Berger Urges Council of State to Protect Citizens’ Rights

Commissioner Cherie Berry Proposes Lawsuit Challenging New Health Care Law Be Discussed At Next Meeting

Raleigh, N.C. – Senate Republican Leader Phil Berger (R-Rockingham) sent a letter to each member of the Council of State today urging them to support Cherie Berry’s motion to discuss at their next meeting joining litigation thirteen other Attorneys General across the country have initiated by filing a lawsuit to challenge the constitutionality of the Patient Protection and Affordable Care Act.  The constitutional challenge rests on the argument that the individual mandate by the federal government to citizens forcing them to purchase health care is an unconstitutional overreach of the authority granted to the federal government by the Commerce Clause.

Earlier this week, Senator Berger sent a letter to Attorney General Roy Cooper asking him to join the lawsuit or initiate similar litigation on behalf of North Carolina.  A recent Rasmussen poll found that 51 percent of likely voters support North Carolina’s participation in the suit.

Senator Berger made the following statement:

“We all must do our part to protect North Carolina’s citizens from this unprecedented and unconstitutional expansion of federal power being handed down in the form of health care mandates.  North Carolina citizens should have the right to make their own health care decisions protected.  I hope that each member of the Council of State will join me in urging Attorney General Cooper to file suit to see that the rights and freedoms of North Carolinians are safeguarded at the state level.”
